Investment Fund Litigation

For decades, our litigation group grew and flourished alongside the firm’s storied investment fund practice which has represented the interests of private investment funds, their advisors and their principals. Our significant experience solving the unique legal challenges faced by fund managers forms the cornerstone of our acumen in representing them in all forms of litigation and contested matters.

We represent funds in state and federal courts and before arbitration panels throughout the United States. This foundational aspect of our practice focuses on the enforcement of complex financial instruments and the prosecution and defense of investment-related actions, business disputes, fraud suits, and activist-initiated control contests and mergers and acquisitions litigation.

We litigate to enforce trades as well as investment fund rights under credit agreements, indentures, warrants, subscription agreements and many other types of instruments, and to pursue securities law violations. We defend insider trading, “short swing” profit and other securities-related claims, and lawsuits alleging breach of fiduciary duty and a myriad of other fund-related and investor-related disputes.

Our team also represents private investment funds owning positions in troubled companies in avoidance actions and other bankruptcy-related litigation.
