Jason Polevoy spoke about lease renewal and fair market value rent provisions at the New York State Bar Association Real Property Law Section Annual Meeting. He was quoted in the following article with respect to the importance of a lease clearly providing for the permitted manner and timing for the delivery of notices in order for a tenant to properly exercise a renewal option, or any other material tenant option, and for a tenant to precisely adhere to the requirements of the lease when exercising such an option so as to avoid the potential for any dispute as to whether an option was validly exercised by a tenant.
